Radio Surf - Photographer Agreement

Radio Surf operates an online marketplace connecting photographers with buyers. Radio Surf does not purchase photographs and does not act as the owner of photographer content. The Photographer remains the copyright owner of all uploaded images.

By uploading photographs you confirm that you are the sole owner of the copyright or have full rights to license the photograph. You must not upload stolen photographs, photographs owned by others, or copyrighted material you do not control.

By uploading photographs you grant Radio Surf a worldwide, non-exclusive license to host, display, promote, and sell licenses to the photographs for the purpose of operating the platform.

The Photographer is solely responsible for ownership of the photographs, ensuring the photograph does not violate third-party rights, and compliance with applicable laws. Radio Surf does not verify ownership of uploaded content.

Surf photographs may include individuals engaged in public sporting activities. The Photographer is solely responsible for ensuring that publication of the photograph is lawful and does not violate privacy or publicity rights.

Photographers set their own prices for photographs. Radio Surf does not control pricing.

Radio Surf may charge a platform fee of up to 20% of the sale price. The remaining amount will be paid to the Photographer.

Payments are processed through third-party providers such as Stripe. Photographer payouts are handled through the payment provider. Radio Surf is not responsible for payment delays or issues caused by payment providers.

Photographers may remove photographs from public listings. However, buyers who purchased the photograph retain their license and purchased photos may remain accessible in buyer accounts.

Radio Surf may remove photographs for reasons including copyright complaints, violations of Terms, quality concerns, or legal requirements. Photographers may be notified via email where possible.

Radio Surf may suspend or terminate photographer accounts at any time for reasons including copyright violations, repeated complaints, or fraudulent activity. Accounts may also be terminated without explanation.

The Photographer agrees to indemnify and hold harmless Radio Surf against any claims arising from uploaded photographs, copyright infringement, or violation of third-party rights.

Radio Surf shall not be liable for lost sales, lost revenue, or indirect damages.

This Agreement is governed by the laws of Spain. Disputes shall be resolved in the courts of Spain.
