Radio Surf - Terms of Service

Radio Surf operates an online marketplace that connects photographers with individuals who wish to purchase surf photography. Radio Surf acts solely as a technology platform and marketplace facilitating transactions between photographers and buyers. Radio Surf does not own the photographs uploaded by photographers and does not act as the seller of such content. All purchases are transactions between the buyer and the photographer.

To use the Service you must be at least 18 years old, have the legal capacity to enter into a binding agreement, and comply with these Terms. Radio Surf may refuse service or terminate accounts at its sole discretion.

Users may create accounts to upload photographs, purchase photographs, and access purchased content. You agree to provide accurate information, keep login credentials secure, and be responsible for activity on your account. Radio Surf may suspend or terminate accounts at any time without notice or explanation.

Photographers may upload photographs to the platform. By uploading content, the photographer represents and warrants that they own the copyright to the photographs, the photographs do not infringe any third-party rights, they have the right to publish and license the images, and the content was not copied or stolen. Photographers are solely responsible for the content they upload.

Surf photographs may include individuals participating in public sporting activities. Photographers are solely responsible for ensuring that publication of the photograph is lawful and that no rights of publicity or privacy are violated.

Buyers may purchase photographs through the platform. Prices are determined independently by photographers. All purchases grant the buyer a non-exclusive perpetual license under the Photo License Agreement.

Payments are processed through third-party payment providers such as Stripe. Radio Surf may collect a platform fee of up to 20% of the purchase price. Radio Surf is not responsible for delays or issues caused by payment providers.

All purchases are final. Because photographs are digital goods, refunds are not available once the file has been downloaded.

Photographers may remove photographs from public listings at any time. However, buyers who previously purchased the photograph retain their license and access through their account library.

Radio Surf may remove or disable access to any content at its sole discretion, including in response to copyright complaints, violations of these Terms, quality concerns, or legal obligations.

If you believe a photograph infringes your copyright, contact: legal@radiosurf.online. Radio Surf may remove the content while the matter is reviewed.

The Radio Surf platform, including software, design, branding, and trademarks, is the intellectual property of Radio Surf.

Users may not upload stolen content, violate intellectual property rights, bypass platform security, misuse purchased photographs, or resell photographs as stock content.

Radio Surf may suspend or terminate accounts at any time. Purchased licenses remain valid after termination.

The Service is provided 'as is' and 'as available'. Radio Surf makes no warranties regarding availability, accuracy, or uninterrupted operation.

To the maximum extent permitted by law, Radio Surf shall not be liable for indirect damages, lost profits, loss of data, or disputes between photographers and buyers. Total liability shall not exceed the amount paid for the transaction giving rise to the claim.

Users agree to indemnify and hold harmless Radio Surf from any claims arising from uploaded photographs, misuse of the platform, or violation of third-party rights.

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Spain.

Radio Surf may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
